PERTH LUXE SOCIAL CLUB
FOUNDING MEMBERSHIP AGREEMENT
By purchasing a Founding Membership with Perth Luxe Social Club, you agree to the following Membership Agreement.
1. MEMBERSHIP
- 1.1 Founding Membership is valid for twelve (12) months from the membership commencement date.
- 1.2 Membership is personal to the member and may not be transferred, assigned or shared without the prior written approval of Perth Luxe Social Co.
- 1.3 Membership entitles the member to attend one (1) hosted social event per calendar month during the membership term.
- 1.4 Membership is subject to this Agreement and any reasonable policies communicated by Perth Luxe Social Co from time to time.
2. MEMBERSHIP FEE
- 2.1 The Founding Membership fee is $840 AUD, payable in full prior to membership commencement.
- 2.2 Membership fees are non-refundable except where required under Australian Consumer Law.
- 2.3 Membership fees may not be transferred to another person or membership period.
3. EVENTS
- 3.1 Perth Luxe Social Co will endeavour to provide three (3) event dates each month.
- 3.2 Members may attend one (1) event per month and may select from the available event dates.
- 3.3 Event dates, venues and times may vary throughout the membership term.
- 3.4 Perth Luxe Social Co reserves the right to change venues, dates, times or event formats where reasonably necessary.
- 3.5 Event attendance numbers may vary from time to time.
4. BOOKINGS AND ATTENDANCE
- 4.1 Members must RSVP by the booking deadline advised for each event.
- 4.2 Places at each event are limited and allocated on a first-booked basis.
- 4.3 Members who do not book an available event within the booking period may forfeit that month's attendance entitlement.
- 4.4 Unused monthly attendance entitlements do not roll over into future months.
- 4.5 Members who are unable to attend a booked event should provide notice as soon as reasonably possible.
5. MEMBERSHIP PAUSE
- 5.1 Members may request one (1) membership pause during the membership term.
- 5.2 A pause may be granted for a maximum period of two (2) consecutive months.
- 5.3 Requests must be submitted in writing prior to the commencement of the requested pause period.
- 5.4 Approved pause periods will extend the membership expiry date by the equivalent period of the pause.
- 5.5 Membership pauses may be requested for travel, work commitments, illness, family responsibilities or other reasonable circumstances.
- 5.6 Perth Luxe Social Co reserves the right to approve or decline pause requests acting reasonably and having regard to operational requirements.
6. CANCELLATIONS
- 6.1 Perth Luxe Social Co is not required to provide refunds, credits or replacement events for missed attendances.
- 6.2 If Perth Luxe Social Co cancels an event and is unable to provide a suitable alternative event, a replacement event or reasonable credit may be offered.
- 6.3 Perth Luxe Social Co reserves the right to cancel, postpone or reschedule events due to venue availability, safety concerns, insufficient attendance or circumstances beyond its reasonable control.
7. INCLUDED BENEFITS
- 7.1 Membership includes one (1) welcome drink at each attended event.
- 7.2 Additional food, beverages and purchases are the responsibility of the member.
- 7.3 The welcome drink offered may vary depending on the venue and event.
8. MEMBER CONDUCT
- 8.1 Members are expected to conduct themselves respectfully and professionally at all times.
- 8.2 Members must treat fellow members, venue staff, guests and Perth Luxe Social Co representatives with courtesy and respect.
- 8.3 Harassment, discrimination, bullying, threatening behaviour, aggressive conduct, excessive intoxication, illegal conduct or behaviour that negatively impacts the experience of others may result in immediate suspension or termination of membership.
- 8.4 No refund will be payable where membership is terminated due to misconduct.
9. MEMBERSHIP SUITABILITY
- 9.1 Perth Luxe Social Co is committed to creating a welcoming, respectful and enjoyable environment for all members.
- 9.2 Perth Luxe Social Co reserves the right to decline a membership application where it reasonably believes an applicant may not be a suitable fit for the community.
- 9.3 Perth Luxe Social Co reserves the right to suspend or terminate a membership where a member's conduct, behaviour, actions or communication are considered detrimental to the enjoyment, safety, wellbeing or experience of other members, venue staff, guests or representatives of Perth Luxe Social Co.
- 9.4 Perth Luxe Social Co will endeavour to address concerns with a member before exercising its rights under this clause where appropriate to do so.
- 9.5 Any decision made under this clause shall be at the reasonable discretion of Perth Luxe Social Co.
- 9.6 Where a membership is terminated under this clause, Perth Luxe Social Co may determine whether any full or partial refund is appropriate, taking into account the circumstances of the termination and any obligations under Australian Consumer Law.
10. LIABILITY
- 10.1 Members attend events at their own risk.
- 10.2 Perth Luxe Social Co acts as an organiser and facilitator of social events.
- 10.3 To the extent permitted by law, Perth Luxe Social Co is not liable for any loss, damage, injury, theft or expense arising from attendance at an event.
- 10.4 Nothing in this Agreement excludes any rights that cannot legally be excluded under Australian Consumer Law.
11. PHOTOGRAPHY AND PROMOTIONAL MATERIAL
- 11.1 Photographs and videos may be taken during events for marketing, promotional and social media purposes.
- 11.2 Members who do not wish to appear in promotional material should notify Perth Luxe Social Co in writing before attending an event.
12. CHANGES TO MEMBERSHIP
- 12.1 Perth Luxe Social Co reserves the right to amend membership benefits, event formats, operational procedures and this Agreement where reasonably necessary.
- 12.2 Members will be notified of any material changes.
13. GOVERNING LAW
- 13.1 This Membership Agreement is governed by the laws of Western Australia.
- 13.2 Any dispute arising from this Agreement shall be subject to the jurisdiction of the courts of Western Australia.
